General Information Clause
In accordance with Articles 13(1-2) and 26(2) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119, p. 1) – hereinafter referred to as “GDPR” – we inform you that:
I. Data Controller
The Data Controller, who decides on the purposes and means of processing personal data, is Optimum Process Limited Liability Company, located in Warsaw, Poland (02-222), at Aleje Jerozolimskie 181B, with tax identification number NIP 5213786607, KRS 0000684901, REGON 367693875.

III. Collection, Processing, and Use of Personal Data
The manner and extent of collecting personal data depend on the purpose for which the data were collected and the legal basis for their processing.
We process personal data for the following purposes and under the following legal bases (legal basis – Art. 6(1)(a-c,f) GDPR):
- to fulfill individual orders including ensuring the correct quality of services (legal basis – Art. 6(1)(b) GDPR) – “performance of a contract”,
- to perform legal obligations, e.g., issuing and storing invoices or responding to complaints (legal basis – Art. 6(1)(c) GDPR) – “legal obligation”,
- to pursue possible claims (legal basis – Art. 6(1)(f) GDPR) – “legitimate interest”,
- marketing of own services during the contractual relationship (legal basis – Art. 6(1)(f) GDPR) – “legitimate interest”,
- marketing conducted through telecommunications means, subject to your consent for using data for this purpose (legal basis – Art. 6(1)(a) GDPR) – “consent”.
The provided personal data are processed for the period necessary to achieve the above-described purposes, depending on the legal basis:
- time of performing legal obligations and the period during which laws require data to be kept, e.g., tax regulations,
- time after which any potential claims arising from the contract become statute-barred,
- time until the withdrawal of consent.
IV. Transfer of Personal Data to Third Parties
With data security assurances, we may transfer personal data to other entities, including:
- individuals authorized by the Data Controller to process data,
- entities entrusted with data processing, e.g., providers of technical services and consulting services,
- other administrators, e.g., couriers.
Entities to which user data is provided may use it in a manner and to an extent necessary to fulfill the purpose defined by the Administrator. Additionally, the Administrator cooperates with advisors who must comply with regulations and security principles concerning personal data processing. The Administrator enters into data processing agreements with individual entities defining the conditions under which they can use the personal data.
V. Data Security
To ensure data confidentiality, the Administrator has implemented procedures, organizational solutions, and technical measures that allow access to data only by authorized persons who process it as part of their entrusted tasks. Actions are taken to ensure that subcontractors and other cooperating entities also provide guarantees of using appropriate security measures whenever they process data on behalf of the Administrator.
VI. Rights of the Data Subject
Every person whose personal data is held by the Administrator has the right to access their personal data, data portability, data rectification, data deletion, or restriction of data processing. Any limitations in this regard can only arise from regulations.
In addition to the rights listed above, every data subject can object to data processing if the legal basis for data usage is a legitimate interest. Upon receiving a request in this matter, the Administrator is obliged to cease processing data for the specified purpose.
Withdrawing consent to process personal data does not affect the lawfulness of processing based on consent before its withdrawal.

Every data subject also has the right to lodge a complaint with the President of the Personal Data Protection Office if they believe that the processing of personal data by the Administrator violates legal provisions.

VII. Profiling
Personal data will not be processed in an automated manner, including profiling.
